Grievance Procedure

Section 504 Grievance Procedure

 

Introduction

Vida Mejor Capital, Inc. is committed to ensuring that no qualified individual with a disability is excluded from participation, denied benefits, or subjected to discrimination under any program or activity. This procedure meets the requirements of Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 (ADA).

Filing a Grievance

  • Who May File: Any person who believes they have been subjected to discrimination on the basis of disability by Vida Mejor Capital, Inc. This includes employees, clients, and other stakeholders.

  • How to File:  Submit grievances in writing using the Grievance Form (PDF) or Grievance Form (DOCX). Alternative means (e.g., personal interviews or tape recordings) are available upon request.

  • When to File  Grievances should be filed as soon as possible, but no later than 60 calendar days after the alleged violation.

  • The grievance form must include:

  • Name and contact information of the grievant

  • Detailed description of the alleged discriminatory action or policy

  • Date(s) of the alleged violation

  • Names of any persons involved, if known

  • Any other relevant information

Investigation

  • Acknowledgment: Within 10 business days of receiving the grievance, the Section 504 Coordinator will send a written acknowledgment to the grievant.

  • Investigation: The Section 504 Coordinator will conduct a thorough and impartial investigation, which may include interviews with the grievant, witnesses, and other involved parties.

  • Confidentiality: Information related to the grievance will be kept confidential to the extent possible, consistent with the need to conduct a thorough investigation and in accordance with applicable laws.

Resolution

  • Findings: Within 30 business days of the grievance filing, the Section 504 Coordinator will issue a written decision, including findings and any proposed resolutions.

  • Appeal: If the grievant is not satisfied with the resolution, they may appeal the decision to the Chief Executive Officer (CEO) within 15 business days. The CEO will review the appeal and issue a final written decision within 30 business days.

Prohibition of Retaliation

Vida Mejor Capital, Inc. prohibits retaliation against any individual who files a grievance or participates in the grievance process. Retaliation is a serious violation of this procedure and will be addressed promptly.
